HSMP - HSMP Dependent's ILR application

HSMP - HSMP Dependent's ILR application

Hi All,
A friend of mine, who is currently in UK as a HSMP dependent (his wife being the HSMP holder) wants to apply for ILR.

He has stayed in this country for more than 5 years and that his wife isn't employed now.

What is the chance of him getting the ILR as a primary applicant?

Is there any rule which states only Primary hsmp applicants should apply for ILR?

Please reply. He is currently thinking of applying for Tier 1 visa which means another 5 years before his ILR.

FLR and ILR can be applied by the main HSMP applicant only. The dependents are tied to the main applicant. Thats why the dependents need not complete a period of 5 years before they qualify for an ILR, provided the main applicant has completed the requisite period and is eligible for an ILR.

Unfortunately in the case that you have enquired about, the main applicant is no longer (as per you) eligible for ILR. The clock resets at 0 for the dependent now if he/she decides to make a fresh application.

How can a HSMP dependent apply for Tier 1? Does he/she need to apply from his native country or can he/she apply in-country in UK?
Also, whether they should apply for initial application or extension?
Please advise.

Duplicate post :cry:

1. Dependents cannot apply for Tier 1 from UK. Why? You will have to ask BIA.
2. And how can a dependent apply for extension under Tier 1 when he/she is not even a Tier 1 visa holder :shock: :D

HSMP dependents are not eligible to switch into Tier 1 (as main applicant). That means if you are an Indian national, you will have to apply for Tier 1 as main applicant from India. This will be an initial application and not an extension.

I am assuming here that the original HSMP holder (the original main applicant) is not in a position to apply under the new PBS (I think you mentiond it in your earlier post).
