Previous Earnings query

Hi Friends,

Can I claim points for a 11 month period skipping one month in between ?

I was not in the UK for one month in between,rather I didnt have LTR during this one month and was in home country to get it renewed.

In this circumstance can I claim for the 5 points for UK Experience?

I believe the qualification for points for Uk experience is based on amount not on the amount of months.

Extract from tier1genpolicyguide.pdf -

123. Where an applicant has claimed points under the Previous
Earnings points scoring area, for both UK and non-UK
earnings, at least £16,000 of these must be UK earnings
before points can be awarded in this area.

Thanks friends for the responses

I am in the Uk and applying the tier1 as within Uk applicant.

Having the required amount to claim for the UK experience,my concern was whether the 1 month absence of LTR will affect showing my previous earnings in UK.

Does the 12 month continuous period means that you should be in the UK for the past 12 months ?

UK experience Query

Hi

I am in UK from Nov 2007 to JUne 2008 , I am getting Indian salary paid in India and Uk allowance here, I got INR 204474 paid in INDIA and GBP 14329 paid in UK

If i convert indian earnings to UK i am getting GBP 2350.27 in India
and total of 2350.27 + 14329 = GBP 16680, I am having more than 16000 pounds required for UK experience


My query is that can I claim UK experience points if I am including the salary paid in India for the duration I was in UK.

Please help me out

Am not in a position to guide you.. but below is my understanding and what i did.

I applied for Tier1 last week from India. However, i claimed 5 points for UK experience coz my Uk earnings during the period comes to 13000GBP. However during the same period i've 4000GBP of Indian earnings -> totally comes to 17K. Hence 5 points claimed.

I would advise you to wait for others to reply if you still need some assurance.

Well this is tricky. As per the guidance notes -

122. The earnings, for which points were awarded under the preceding area, were earned in the UK.

123. Where an applicant has claimed points under the Previous Earnings points scoring area, for both UK and non-UK earnings, at least £16,000 of these must be UK earnings before points can be awarded in this area.

Going by this, "were earned in the UK" and "at least £16,000 of these must be UK earnings". In your case the case worker could argue that you have not earned 16K in UK.

For uplift ratio also if you stay in UK and earn in INR, you are not considered for an uplift ratio. Going by this understanding, I would not consider GBP 2350 as my UK earning.

I suggest you leave this off you application form. Hope you are not short of points!

Hi Hussain

Regarding the GBP 2350.27 earning,
I havent uplifted the Indian salary for the period I am in UK.
I have simply converted the INR 204474 to GBP.

I have asked this to some agent in Bangalore Y AXIS and they are telling that the amount paid in India cant be considered for UK Experience, Even if you are in Uk for that period.

shashank thats true. If u read carefully it says amount has to be earned in UK

Hi,

I was not talking about this. Waht you have done is correct. I am using the upliftment factor as an example. As you cannot use the upliftment ratio for INR staying in UK, same way you cannot use the INR for UK exp.
