Refugee settlement status of an employee

Post by Roofi » Sun Nov 18, 2018 7:24 pm

Dear members,

I am preparing my application to apply for Tier 1E (5 years) ILR. I have a quick question.

One of my employees holds refugee settlement status (ILR). His BRP reads as,

Type of permit:
REFUGEE
SETTLEMENT

Remarks:
INDEFINITE
LEAVE TO REMAIN

Does this employee qualify for the award of points under tier 1 entrepreneur?

Many thanks

As long as he has ILR, he is considered to be a settled worker in the UK so yes you can claim points. The refugee route does not matter.

You can only claim for points AFTER he attained the ILR. For example, IF he was employed before he attained ILR that period will not be counted.
