filing a petition and still travelling to usa for holidays

Post by a_bentz » Thu May 22, 2008 9:08 am

can anyone tell me if it is possible to have a petition filed and still travel to the states for holidays? even if the petition takes years to come through the system? i heard from someone that once a petition for permanent residence is filed for a would be immigrant that person cannot then enter the states even for holidays, is that true?
thank you.

Well, there would be a 'conflict' there. Whenever you apply for visitor visa or use visa waiver you claim that you have no intent of staying in the US... there is also a question on the visa app that says smthg like 'Have you ever applied for permanent residence'. Once visa officer establishes you DO intend to stay (doesn't matter whether you wanna do it now or when you get gc) then they might turn you down :?

If you have a visa in your passport or you are from a contry, which is under Visa Waiver Program, you can travel to the United States.
