ILR pbs dependant

Post by Teamdoctor » Tue Dec 25, 2018 11:00 am

Hello there
I’ve been granted Tier 1 Entrepreneur Visa on August 30, 2014 and received my Extension on June 17, 2018 until June 16, 2020.
My 5 years period is coming up on August 30, 2019 so I am going to apply for ILR for me and my family that have been living with me in the UK from the very beginning. Please help me with questions below:
1). My little daughter was born in the UK in July, 2015. Is she eligible to apply for ILR along with us even if 5 years period of lawful stay not fulfilled yet?
2). My two elder kids will turn 15 and 13 at the moment of application. They have been living in the UK with me from very beginning. Should they pass any Language and Life In The UK Tests?
3). What day I should present Absences Report for my dependants from?
4). My spouse graduated 2 years Masters Degree in the UK. Should she pass a Language test?

Your post has been moved to your own topic from the member's thread you had tagged your question onto. This is not only unfair to the other member, but also causes confusion.

1. Your UK born child does not need ILR if you plan on registering her as British.

2. No. It is only required for applicants 18 and older.

3. 11th January 2018. They will be subject to the 180 days absence limit per 12 month cycle.

4. No, degree is fine but she also needs Liuk.

Thank you my friend!
All clear except my little daughter. Could you please give more detail on options I have for her.

1) If I want to register her as a British Citizen

2) If I don't intend to register her as British Citizen but want to have ILR for her

1. You can register her as British on form MN1 once either parent is granted ILR. She has an entitlement to register as she is UK born. Costs £1012 currently.

3. If you don't wish to register her as British, you will need to apply for ILR which costs a lot more than citizenship and is lost if absent from the UK for 2 or more years.

Yes. There is no 5 year residence for small children.

Hello my friend
I have one question. You said above that absence should be no more that 180 days in 12 month. I thought that in any 12 month period after January 2018. Could you please explain this point with possibly sample.
