change of spouse status after British citizenship (Directive 2004/38/EC)

Post by wahi66 » Sun Feb 24, 2019 1:28 am

Hello

Does the grant of British nationality to non-EU national gives the same rights to its non-eu spouse automatically specifically when travelling to other EU states as per directive 2004/EC??

or

after change of nationality the other spouse needs to change the status of the BRP which will sahow the wording of family member of EU national??

The spouse of a British citizen living in the UK cannot get a residence card stating "family member of EU citizen". The non EU spouse visa holder will need a visa for Europe.

so the visa for other countries would be simple standard tourist visa or the spouse will get any relaxation in term of paper work or fees? or the duration of visa etc?

I mean the procedure would same like normal tourist visa where ticket hotel etc needs to be book in advance or they can issue the visa and then the trip can be planned up?

In principle the latter, but there may be a problem with proving that the non-EU spouse will be travelling with the British spouse.

In principle, if you will pass through transposed border controls (e.g. Eurotunnel), a British marriage certificate will suffice for a visa if you travel together.

Only if travelling through the juxtaposed land or sea borders, as you can interact directly with the French border police.

Airlines would still require a visa stamped into your passport before they allow you to board the flight.

So by air/train they treat non-EU spouses as normal visitor? and even when you apply for visitor visa lets suppose there is No favour or relaxation will be given in term of
1. visa fee
2. extra visa time like months or more
3. extra documentation they usually ask like employer letter, ticket, hotel, bank statement etc???

plan is to visit in april and then june and then july to different places on different events for around one week every time so is there any possibility to get long visa with multiple entries??

For spouses of British citizens to visit the rest of the EU, they still need a Schengen visa.

1. visa fee
Should be free, while we are still in the EU. Not sure of the situation after Brexit.
You may however have to pay for the agency fees, which some embassies require. You have the right to go directly to the relevant embassy, but they can have a limited set of specific hours per week/month only.

The standard six months multiple entry.

Pre-Brexit, different proof. Generally just proof that the spouse is a British (therefore also an EU) citizen.

Given the state of the Brexit negotiations, I would suggest postponing your travel plans as the situation as regards traveling to the EU will be very fluid.

Moving this thread to the Europe immigration forum, as it is not about EEA Route Applications in the UK, but visiting Europe.
