Tier-2 to Tier-1 - Is this possible?

I would like to know if I can switch over from Tier-2 to Tier-1 Visa?.

Tier 2 doesn't exist yet so no rules have been announced. I suspect you will be able to switch into to Tier 1 (General) though - it would make no sense if you could not.

See this ANNEX C: SWITCHING WHILE IN THE UK INTO AND OUT OF THE SKILLED MIGRANT TIER.

The final arrangements should be in line with this document.

Employer Issues

Dear Friends,

I understand from the forum that it is possible to switch from work permit to tier-1 once I am in UK. this is good news.

I have a query on the process itself.
1. Will my employer get to know that I have applied for Tier-1 visa ?
2. Will there be any problems once I switch from work permit to tier-1 and continue to work for the same client/employee?.

Yes, when you ask him to provide the stamped salary slips :wink: and when someone calls up for verifying your employment details.

Yes:- problem to your employer as you can ditch him any time
No:- for you, as you will be a free bird now and can stay in UK till your VISA is valid, whether or not you have employment.

Not necessarily! For example, the current processing time for in-country applications (advertised as 10 weeks now) is perhaps much higer than for applications from India (4-5 weeks it seems).

Also, could depend on your personal circumstances. I would say that it is not appropriate to generalise and say it is easier from UK than India (or vice verca).

What's the basis of your understanding?? Hearsay ??

Well it has not started yet but as far as I know there is never a restriction in changing your immigration status if you are legally in UK. It would be same for switiching from Tier 2 to Tier 1. Current example is people like me who are switiching from Work Permit(New Tier 2 in future) to Tier 1.
