Hello
I'm in a confused state, I'm a non eea and with a five year residence card
but I'm currently not in good terms with by British citizens husband as he
has been threatening me on countless times and I have proof of his audios and his
mentally unwell and I have video proof when he was at hospital and during that time he cut his neck with a sharp stone. I left UK for 18 months but I did not intend to stay that long but he sent me audios threatening me if I returned, and I stayed there longer than I should have. My Kids were in school there. I came back in January but he didn't know the date I was returning because I decided he shouldn't know as I realized he was not on medication again and but somehow figured that out and he
continues to threaten me. I went to apply for housing and I was told to let home office know I wasn't staying with my husband and get a new status for myself and if I have proof of his threats I should let police know. Both my kids are British citizens though my elder child her passport expires next year February

Did you live with your husband in another EEA state prior to coming to the UK?

Yes I did. For almost two years but I have no proof just his doctor hospital document in Norway

All the papers are with him but he didn't work here in UK, he claims disability allowance.

But he did work in Norway? Did your child live their with you? HOME Office may have record.

Yes he worked in Norway and my child was born there in Norway. But my second was born in uk.

You could qualify, but I am concerned by the 18months absence, what was it for?

I was coming back to UK sooner but he sent me audios threatening me if returned he would kill me and he sent that on audios

My two girls are small and I was afraid to bring them back in a situation like that and even now he still won't take his medication

Any evidence of domestic violence or threat? Did you report to the police. Why did you not seek to have him sectioned under the mental health act? He is clearly a threat to himself.

I have many audio recordings from him threatening me. I haven't gone to The police yet when I came back I went straight to my sister's.

You need to inform the council that you qualify under the Surinder Singh provision , and most especially Regulation 9.

If you inform them of that, then you will not be required to inform Home Office of anything as you are yet to divorce. If they continue to refuse then you will have a good prospect of success.

Please don't constantly repeat the same question! No one can guarantee whether the absence will be disregarded or not, which is probably why you haven't received a response.
