I’ll keep this very simple. Person ‘A’ moved from Tier 4 UK to Ireland before Tier 4 expiry in 2015.
- 2016 applied for EU treaty rights as family member of EEA national
For whatever reason an expired passport was submitted - assuming because of delay in passport renewal from own non eea national country
To date - no contact from authority/no deportation etc
Postal address changed since - person A has apparently notified of postal change
- Person A has not registered with Irish authority (as I understand a requirement from Irish gov website [whatever it’s called]
- Person A does not have temporary stamp to allow to work and is working cash in hand

What is the status of this person? I assume illegal as authorities do not know but application for eu treaty rights pending therefore they do know?

Any thoughts?

Also - should Person A return to home country, will any future spouse visa application into the U.K. be negatively affected - note a full declaration will be made
