Desperately seeking for help [UK Immigration]

Hey! This is my first post on reddit and I really hope someone here could help me.



I've been having problems trying to find some information since most lawyers charges up to £2,500+ which is pretty expensive plus the visa fees which will be looking at £4k - £5k. So here I am writing this post in hope that anyone else here might have experience in the immigration law.



My husband (British) and I (Colombia) were living in Colombia for 3 years, and we have a child under 2 years old who is dual nationality (Colomobia/British), and we are civil married. We recently came to the UK on a visitor visa for a 6-months period, and my visa will be soon ending in 4 months. We've been trying to figure out if we need to apply for a spouse visa or any other type of visa that state that I can stay because my child as now settle in the UK with my husband. As for the spouse visa, i was told that I have to leave the country to re-apply for a new visa but that is impossible since my husband is the one who pays everything and there no way I could leave my child ... My husband also said it could not let that happen, so that would mean for him to loose his job if he has to go back to Colombia and this could be a catastrophic .



Question:

What visa do I need?

Can I apply from the country?

Can it be switch from a visitor to any other visa that is settlement?

How long will it take for me to receive permanently stay?

You need a spouse visa.

You can only apply from a country where you hold legal residence (like a non-visitor visa in the UK). You cannot apply for this visa as a visitor to the UK. And no, it doesn't matter that this is very very inconvenient for your family. The rules are the rules.

You cannot switch from a visitor visa to any other visa from within the UK. Again, it must be from a country where you can legally reside (hold a long stay visa or citizenship).

Application times vary by country of application and time of year. Anywhere from a few weeks to 6 months.

Honestly, you should have done a bit more research before moving to a new country. Presumably your husband did research before moving to Colombia??

Best and easiest way will be to return back home and apply for spouse visa otherwise through extremely expensive & stressful way you might get leave under 10 years based FLR fP route.
