Tier 2 ict dependent to tier 2 General

hi all,

i am on dependent visa ict and working in a permanent job. Planning to apply for tier 2 general but need to understand the time line for resigning the job

My notice period is 1 month. So by when should i be relieved from from current job ?

Can i give notice once if get my new COS and wait 1 month to go out of country to apply new visa ?

hi cr001,

Nope as of now but have asked the same to current employer to when discussed about leaving the organisation.

So if the rules are different in case of same employee and a new employee ?

You have to apply for Tier 2 general from your home country. If approved, your ICT dependent visa will be cancelled automatically and you can only return to the UK and work only for your tier 2 general sponsor.

You will therfore need to resign before you apply if it is not your current employer sponsoring your tier 2 general visa.

If your current employer is sponsoring you and have completed the full and proper RLMT process, then no need to resign.

Ok so considering the new employers scenario:
1. Wait till COS is assigned from the new employer
2. Give notice period to current company wait for 1 month. Go to home country after 1 month as cos is valid for 3 months. (i think so) and apply for the t2 general.
3. come back on new visa and join the new company.

If the above is correct from what i understood ??

so i got more confused..

if i get my t2 2019 - the salary is 37k. valid for ilr is 35800...

at the end of 5 years - 2024 - the ilr valid salary is 40k. but i am on 39k.. so am i eligible as i got into job when salary was 37k..

For ILR you must meet the salary set for ILR or what your SOC is, whichever is higher. If you don't meet the ILR requirement, you will be refused.

No one can say what the rules in 2024 will be.

ok so at the time of getting the t2 general that matter and nothing about future increase or decrease ...
is there a page where i can see the SOC and the set salary on UKVI ? Tried google but did not get authenticate source ..

Hi
So the circle around my sponsorship is going round and round.
I am on dependent visa and my current employer is ready to do my t2 General.

So I have below questions
- does it require rlmt?
- do I have to go to my home country for applying or it can be in country?
- is there any benefit of the current employer doing t2 General in terms of process or anything?

1. Yes rlmt is required if not a shortage occupation.

2. You have to apply from your home country as already advised in may, nothing has changed regarding this.

3. Not sure what you mean by this?? All sponsors have to follow the same process and rules.

Ah.. Got it... By question 3 I meant that if current employer do the t2 g.. Is there any benefit in terms of process.. But as u said it is treated in similar manner.. So that cleared too..

1. how long any other company cannot assign cos in my name when one cos is valid ?
2. can the previous cos issuer inform UKVI to cancel the cos and then i can apply for new one ?

The employer has to withdraw the CoS before a new employer can assign another CoS to you. RLMT needs to be done and the RCoS request goes into the monthly allocation meeting.

cool.. and if the current employer do not withdraw cos.. the cos will auto expire if not used after 3 months ?

You are PBS Dependent NOT a 'work permit holder' which is and was a specific visa category prior to the PBS route.

You need to meet the English requirement, otherwise you will get 0 points for English.
