Hello it will be great if anyone could shed some light on this-
On HO website it says that bare talaq nama from Azad kashmir is recognised if -
· the husband and wife are both domiciled in Azad Kashmir, and
· neither partner has been habitually resident in the UK in the year immediately preceding the pronouncement of the divorce.
Now the question is that what if the wife is domiciled in Azad kashmir the nikkah took place in Azad kashmir but the husband is the resident of France as well as national of Pakistan living in France and sends the overseas attested bare divorce deed from France will this divorce deed be accepted by UKBA along with the official authority’s (tehseel mufti ) confirmation letter of divorce? Note that marriage was registered in Azad kashmir and never in Pakistan plus wife was Domiciled in Azad Kashmir where no union council is involved and bare divorce paper is officially accepted It says on the website that both husband and wife have to be domiciled in Azad kashmir but the husband was not domiciled in Azad kashmir. He is from Pakistan Punjab and resident of France. Will HO accept that?
Neither partner has been habitually resident in the Uk ever.
