Tier 2 ICT to Tier 2 General Dependent Query

Asking on behalf of a friend.

First entry - Main applicant Wife - Tier 2 ICT - Husband and kid entered as Tier 2 Dependents.

While the family was in UK, husband found a sponsor and went back to home country and applied a Tier 2 general and came to UK with the new VISA

Currently the VISAs are still the same Husband T2G, Wife T2 ICT and kid T2 (ICT) dependent.

Now since wife's company sponsors her ICT visa, she can't switch VISA. If she switches to T2 dependent she can't continue in the job due to the company policy.

Can she and the kid continue in the Tier 2 ICT VISA and the dependent VISA until closer to the time when husband is eligible for ILR and then both of them switch as T2 dependents of the husband and apply for the ILR.

Will the time spent in T2 ICT count for her ILR as a dependent? Or is she better of converting as T2 dependent now and find a new job?

Theh need 5 years as PBS dependents before they will qualify for ilr

No ICT does not count for ilr.

Just a follow up question on this. Now they have decided to switch as T2G (PBS) dependents. I assume both the ICT holder and ICT dependent can switch as Tier 2 General dependent in UK and dont have to travel to home country. Could you please confirm?

They can apply for tier 2 dependent visas within the UK. Once her visa is approved and she has her BRP card, she will need to update her employer.
