Tier 2 ICT to Tier 2 General

Hi,

I am in Tier 2 ICT and currently in UK since Nov 2018. I was offered a job by another company in Tier 2 General visa. The salary is below GBP 159,600. When I said Cooling off period applies, they said they can get workaround by applying from India as India employee and the fee is bit higher. Is it possible to avoid cooling period using this method?

It is not possible to avoid the cooling off period.

You don't work for the company in India so you would also fail the 12 months evidence of working for an Indian company.

The rules are strictly enforced, you cannot bend them to suit your circumstances.
