Hi All

I come across an interesting situation and unable to find answer, wonder if you guys can help


My uncle (age 70) is in UK on visitor visa. His spouse is British citizen (over 60) and claiming state benefits. Now can my uncle apply for settlement visa while on visitor status?

If you forward me to any links, forms, fee etc. Appreciate your input

It effectively mean that he need to either go back and apply for spouse OR he can apply for extension as visitor?

Is there any particular reason why an extension of the visitor visa would be granted? For example, any health problem stopping him travelling? Or something like that?

na, his health is fine but his spouse(who is british national) facing serious illness.

So is he the only one able to look after her? Or are there other family members who can help?

Or put it another way, if he was not in the country, who would be looking after her?

I think he needs professional advice, in order to make possibly an "outside the rules" application for a spouse visa, or or least an application for a visitor visa extension.

No doubt medical evidence of his wife's condition will be very important here.
