appeal

Post by dreamer2 » Mon Mar 11, 2019 8:00 pm

HI, I have received email today that instead of 5 years rote I was granted to 10. After telephone conversation I understand that I did a really stupid mistake. I put the money in the bank on 6th September , got super premium appointment on 8th March to make sure that the money is 6 months in the bank but did not think that they will count it form the date of application was submitted. I have still money in the bonds and they were longer than 6 months there under my name and I can get the statement. Anything I can do yet? THis is really stupid mistake...

What date did you submit and pay online??

If the savings were not in your account for 6 months or more on the application date, then the decision would be correct.

Seems like you had applied on savings route which wasn't 6 months older until the date of application. isn't it?

Yes, as I said above I misinterpreted the dates and thought that the date of my appointment at Premium Service will be the date when of my application. I had appointment on the 8th march and applied online on 21st February. I know this is my mistake , but we do can meet financial requirements. Will I be able to appeal at least? I also sent email last night explaining why it had happened and explaining my miscalculation. Is any chance they can review my application?

Reapplying will be quicker.

It is the applicants responsibility to make sure they meet the requirements. You misunderstood and therefore did not.

You cannot appeal if you have not been given appeal rights, your letter should state if you have.

If I will not be able to switch back to 5 years route it will mostly affect my 20yo dependent son. As I understood during the next few years he has to be single and leave at the same address and by the end of this he will be 27yo! Am I right ?

Child dependent over 18 on 10 years route

Post by dreamer2 » Wed Mar 13, 2019 6:05 pm

My application with dependent son was switched from 5 years route to 10 years. By the time we will be able to get ILR my son will be 27yo. Under 5 years route dependent child should be single and live at the same address though he can work. Does these rules still apply for 10 years route?

IHS refund, paid twice

Post by dreamer2 » Wed Sep 25, 2019 12:32 am

Hi, I had apply to extend my family visa but mixed up with new rules for application date and therefore failed with my financial documents but was given a 10 year route visa as I have a British child.
This decision was very harmful for me and my 20 years old dependent son and I had decided to reapply as I didn't have right to appeal. This time I was successful and received leave to remain on 5 years route as I applied initially. Then I have asked HO to cancel my 10 years route visa but they said that they can not do it as decision was lawfull. My situation is very complicated and I think the officer just didn't understand what I had ask for . What I have now: I believe in the system I have two applications, I paid twice for IHS for both, myself and my son. My question is how can I get refund for IHS? Is anywhere I can contact about refund? I believe that it shouldn't be doubled payment .
