Hi all

I'd like to find out if I can apply for Indefinite Leave to Remain in the UK.

I am Australian, and have been living in the UK since April 2003. I've been told two differing stories with regards to obtaining ILR.

I have spent my first two years on an Australian WHM visa (allowing me to work the whole two years). I then obtained the HSMP and am currently in my 4th year on that visa.

With regards to applying for ILR, some people have told me all I need to do is prove I have lived in the UK for 5 yrs and show 5yrs worth of P45 / P60's.

My understanding is that the first two years being on the Aussie working holiday visa means absolutely nothing :-(

Not sure if I really want to do another 2 more years and apply for the HSMP extension for a second time ….

Any advice from senior members? There must be plenty of others in my situation?!

I dont think the WHM visa counts but I may be wrong.

Unfortunately, time under WHM may not be included (135G(i)) for settlement under HSMP.
