Tier 2 to ILR

Post by ifahds » Mon Oct 07, 2019 3:08 pm

I have a query regarding Tier 2 to ILR please.

Tier 2 General valid from May 2014 - May 2020 (SOC Code: 2137)
SOC code 2137 was added to the shortage occupation list on 6th Oct 2019.

Question: Does the exemption from the 'minimum salary threshold' of £35,800 because SOC code is now on the shortage occupation list?

Tier 2 Policy Guidance (Version 10/2019) Page 64 & 65
273. You will be exempt from the minimum earnings threshold if any of the following apply to
you:
You have been employed in a job:
• that appears on the Shortage Occupation List in Appendix K, or has appeared on that
list during any time you were being sponsored to do that job during the last 6 years;

Not applicable to you. Old rule applies

Its only applicable for people who got RCOS assigned after Oct 6th 2019.

As an update, I've applied for ILR anyway. It was bit of a risk. I've been successful. Due to get BRP soon.
It doesn't matter it was old or new COS. The job has to be in Shortage Occupants List in the last 6 years.

There's a reason there are shortage of workers for the job, the gov doesn't want to make it Very Shortage Of Workers, :D sending home already working people and screwing up the organisations. That is not a great idea.

Good luck to the future COS added to SOL, am I eligible for ILR holders.
