From what point to count residency as family member?

From what point to count residency as family member?

Good afternoon,


I would really appreciate for an advice regarding my situation since I am really in doubt from what point to count my residence in UK as a family member of EU citizen.

I came to Uk on Tier 4 visa.( October 2017) I got married in overseas in February 2018 and came back to Uk using my Tier 4 Card.

In July 2018 I applied for Residence card as a eu family member and card was granted in October!


My question is from what date to count for settled status application? February or July or October?

You can start counting from the answer to the above, that is, when you came back to the UK as a married person, married to a EU citizen.

Yes I came as a married person but used tier 4 cars to enter Uk (not family permit). So I should count from February?

I asked when, not if, you came back to the UK as a married person.

What visa you used is irrelevant. The date you came back to the UK as a married person, married to a EU citizen, is the date from which you can count your 5 years toward Settled Status.

Tier 4 doesn’t count. Since you got married and moved to UK counts.
24.01.15-31.12.19:Tier 4 visa
02.08.19: Applied to Lounes PSS
08.08.219: Passports back with biometrics letter
12.08.19: Biometrics submitted
15.08.19: CoA issued (received on 19th)
30.08.19: PSS Granted
09.09.19: BRC arrived
31.11.19:BRC replacement
