Hi,

Can tier 2 migrant work from home (from India) for 5 months based on employer approval? is it legal?

Hi,

I am due to ILR on Dec 20th, 2019 and I was around 168 days out of the UK in these 5 years.

20 June 2015 to 18 Oct 2015 - 121 days out of UK with the previous employer who went to administration and I do not have any person to contact and get those information/letter and also I delivered baby in April 2015 so visited family with baby and I was doing part-time work and salary is been paid)
2 Sep 2017 - 18 Sep 2017 - 17 days (current employer)
7 Sep 2018 - 23 Sep 2018 - 17 days (current employer)
25 March 2019 - 6 April 2019 -13 days ( current employer - a business trip for Netsuite conference)

I do not have a problem with getting a letter from the current employer. Can you please guide what needs to be mentioned in the absence letter for the previous employer. Did I need to really need to have a letter from the previous employer stating working from home? Please help

Yes as long as your on a UK Payroll its fine.

Make sure your not away more than 180 days in consecutive 12 months, it will effect your ILR in future.

Sorry, one more query. I was working from home (part-time -27.5 hrs not 37.5 hrs) in India in the past year for 5 months after my baby arrived. So in the UK absence letter i am a bit confused about how to do self-declaration of it. My previous employer went to administration and so I cannot get absence details in India.
