Tier 2 General to PBS Dependent

Hello,

My spouse has held a Tier 2 General visa since April 2014, before which she held a PBS Dependent Visa for 18 months (based on my Tier 2 ICT). She's had it for 5 years and w.r.t time, she's eligible to apply for an ILR. However, due to circumstances, she had to switch to part-time working rather than full time.

Due to this, she may not be meeting the minimum salary requirement for ILR application, even though the job is in shortage occupation list.

Hence, instead of making an ILR application, we plan to make a PBS dependent application (based on my current Tier 2 General visa).

Is there any issues that I should be worrying about in making the PBS dependent application?
I am thinking if this approach is legal and also hoping that my spouse could continue holding her current job.
