Can I do a pre action protocol for not receiving BRP after 12 weeks

Hello,
Please suggest me.
Tier 2 general Visa approval - Oct 1st 2019
Main applicant brp received - Oct 4th 2019
Dependent brp not received - till now
It’s been nearly 12 weeks. Same response from brp teams saying technical issue. And my dependent left the country thinking that we would receive it soon so that I can courier him to india. But no brp still. This is so frustrating and he is stuck in india.
Can someone suggest me wat possible actions can we take?
Can he apply for a fresh dependent application in India?
How long can he wait in india hoping for brp delivery?
Can we do pre action protocol?
How long does it take for brp to arrive after pre action protocol?
Can he apply for a replacement brp in India by any chance?
Pls help, I’m in Uk with a baby and my husband is stuck in india. This life is so stressful. Please give me suggestions. Thank u
