71 days short of ILR dependant application 5 years route

Hello Friends

Please help. My tier2 dependant visa runs out on 5th March 2020 and my five years will be completed on 15th of May 2020 so I am short of 71 days. Please help as I do not want to pay for extension application and NHS surcharge. Is there any way I can apply for ILR directly before my visa runs out?

No. You will have to apply for an extension. Has your sponsor been granted ILR under the 5 year PBS route, or under 10 years long residence. :?:

Also, what is the intial dependent visa issue date?

Thank you very much for replying to my post. My initial visa date was 07/04/2015. I arrived in UK on 15th May. My visa is running out on 05/03/2020 and I am eligible for ILR on 15th of may 2020 ( 5 years in U.K )

Your residence period qualifying starts from the initial visa issue date, not date you arrived in the UK.

Apologies CR001/Casa, It is not clear about the conclusion of this post, I am also having similar issue for PBS dependants.

So, based on the initial visa date it is a shortage of 32 days, So has to apply for PBS extension and not eligible for ILR. is that correct?

I am aware that I can apply for 28 days in advance. still around 5 days short. Is there any way out of this trap? Would really appreciate your help. Thanks

You can apply for ILR before the visa expiry and enrol biometrics later (when you are in the eligible window for ILR)

You must calculate the relevant qualifying period by counting backward from
whichever of the following is most beneficial to the applicant:
• the date of application
• the date of decision
• any date up to 28 days after the date of application
