Eu settlement and 5 year

Post by Alijee786 » Wed Jan 29, 2020 9:58 pm

Found below details which says you can be considered for settled status even if you are living less than 5 years in uk!

you will be considered for settled status’ (if the Home Office can see evidence that you have lived in the UK in accordance with the eligibility criteria for five years or that you meet the criteria for 'settled status' having been here for less than five years); or
‘you will be considered for pre-settled status’ (if the Home Office cannot see evidence that you have lived in the UK for less than five years, but live in the UK currently)
If you are considered for pre-settled status but disagree with this (because you have been here for five years or longer or meet other requirements for settled status) , you can upload further evidence to show how long you have been in the UK. The form will tell you the period for which there is missing information and you only need provide information for that period. The Home Office prefers one single piece of evidence (ie a letter of attendance from an educational institution covering a three year period). This can include evidence that you were absent for an ‘important reason’ such as study abroad. You won’t be shown your data unless you are challenging your ‘pre-settled’ status status. You will be asked if a caseworker can contact you via email or phone and if you don’t think you can provide evidence, a caseworker will contact you after submission to help you find a way to prove your status.

There are also cases where one can achieve PR in less than 5 years. The most notable addition is that children will be granted ILR under the scheme when a parent has been or is being granted ILR under the scheme rather than the children waiting until they have been in the UK for 5 years. This generally extends to stepchildren otherwise eligible for limited leave to remain.

Good to know because some people were getting concerned that home Office might have given a wrong decision as they were living in uk less than 5 years. So it is possible to have settled status even you have less than 5 year residency
