WP1 OR Tier 1 within deadlines

I need your suggestions for Tier 1 (General) application. I am working in UK from past 2 year and my existing visa (Fresh Talent) which is going to expire on 20th Oct 2008.

My employer has already got a Wp1 refusal letter last week and we are planning for a fresh application next week which will take another 9 weeks for getting the result (4 weeks advertisement and Average 5 weeks for getting result) i.e., 13th Oct. But if the result or paper work will take more than 9 weeks then what i can do........

Regarding Tier1, i will be eligible to apply on 15th Oct 2008 due to 3 months maintenance clause (14July- 14th Oct). I am in a dilemma to go for Wp1 / HSMP.

Just for your information, my job does not comes under skills shortage category and i am working for a new and small employer (established in 2007). But our balance sheet is very strong.

If all other documents are ok(salary slips, bank statements, education qual., etc.) , then why not go for Tier 1 visa on 15th Oct, 2008?
