URGENT - Second Tier 2 general visa application without joining employer

Dear Team,

I'm in a dilemma and it would be great if you could provide your kind suggestion on the following scenario:

1. I got redundant by my first employer on 19th January 2020, after working with them from 08 January 2019. I was sponsored by them for 5 years of Tier 2 general visa. I have completed 2 years on that visa.

2. Now because I was redundant. After 10 days of looking for a new job. Finally I got successful and the new employer(E1) has provided me an unrestricted COS and I have submitted my premium application today.

3. My joining date with the employer(E1) would be start of March 2020.

4. I'm also in talks with an employer (E2), which is a very big company and has a way better role for me and is great for my career.

5. Assuming I get offer from employer E2 and they start working towards getting me a COS. Is it possible I extend my joining date with employer E1 and once I get my new COS from E2, I apply a new application for visa using COS from E2. Can I start with Employer E2 without joining E1.

6. Also, does the employment gap of 60 days matter now for ILR.

The reason why I have submitted the visa application using Employer E1's COS is to come out of 60 days curtailment period.

Please suggest, if it is fine to not join employer E1and get the visa. Then join E2 before the joining date of E1.
P.S: I have paid myself for the visa costs for E1 and is subjected to be refunded once I join.

Hi,

I request you to please help me with my query as below:

1. I was made redundant by my first sponsor after working with them for 2 years and 1 month.

2. After struggling for 10-15 days, got a sponsor who gave me the COS and I had applied to get the visa. I have received the BRP card now. (The new employer offered me a salary which was even lesser that my first employer. I just accepted the offer to stay in the UK.)
I'm due to join them in April 2020.

3. I recently got an offer from a well reputed company, who will sponsor me.

4. Can I apply for the new Tier 2 general visa, before joining the company who sponsored me after getting redundant from the first employer.

Please help me. I'm in stress due to this. If it is going to cause issue, what can I do to apply visa using new COS(to be provided to me soon)

Congrats mate! This is a very sensitive situation though... I suggest that you consult with an immigration lawyer who will give you an answer on the spot based on your particular circumstances.

What do you reckon?
I have consulted a couple of people (they are not immigration specialists), tget said it is completely OK, to join E3 without joining E2.

I just have to inform E2 once my BRP is issued from E3, that I'll not join.

Any help from other folks/members appreciated.
