Self employed 50k Tier1 E to ILR

Dear All

I am applying for ILR on 5 year basis this month.I am a self-employed under 50K route.

My question is based on Tier 1 (Entrepreneur) of the Points Based System–Policy Guidance v 10/2019, page 29:

"(e) If you were self employed at the time a settled worker was employed by your business, you must provide evidence of your registration with HM Revenue and Customs showing your business was based in the UK and a personal bank statement showing all the payments made to the settled worker in the full period of employment used to claim points."

My first question is, "a personal bank statement showing all the payments made to the settled worker in the full period of employment" means I have to provide all my business bank account statements showing my payments to my employees?
I have a business bank account for my business.

2nd question: I have paid all the payments to my employees through my business bank account except 2 months that he asked to get cash. Is it a problem?

Are you a company director or registered as self employed ??! Remember working for your own company as a director is NOT self employment. Self employed have to be specifically registered with HMRC. If you actually registered as self employed and you are NOT a company director, then you must send 'personal or business' bank statements to show you made these payments including cash withdrawals

Many thanks Zimba for your answer,

I'm a self employed and registered with HMRC since 2014.

I've made all the payments to my employees by my business bank account except the last two payments to one employee (Ha has been working for 13 months and He is no longer works for me)

There are no cash withdrawals in my business or personal bank statements for this matter, I paid his 2 last salary with cash that I had in my hand.

So, based on your explanation, should I go to my bank branch and ask for cash (exactly equal to the amount of 2 wages)?

Is this the only way?

Not to mention that, He already emailed me that he received all his wages while he was working for me.

Really appreciate if you could advice me.

Cash in hand is fine as long as correct taxes are paid. You may have to explain this in a covering letter

Can I ask you one more question, Regarding to NI 2 contribution. I am under £6,365 so I don't need to pay NI2. It's written on my TAX Return. Is that enough to submit TAX return to show I'm exempt?

Ok there is no such requirement to submit Tax return but how can I show I am exempt to pay NI2?

A few member already got ILR refusal based on not submitting evidence for NI2

Thanks, You are right, there is not such requirements for ILR application.

(I am a self employed, registered with HMRC in 2014)

1)Two passports (main & dependant)
2)Two photos for each one
3) 2 BRP
4) 2 Police registration
5) Cohabitation: EDF & THAMES WATER (both names are in the bills).a joint bank acc statements.
TV License, My son birth certificate (2016), two Nationwide accts statements. And all for 1 year
6) Previous passports
7) Life in the Uk & degree certificates

8)12 months business bank statements that shows all the payments to the employees.
9) P45, P60, all Payslips
10) RTI Summary
11)FPS + EPS
12)Hours workers
13)P11

14)Accountant Letter to confirm 2 full-time jobs creation
15)2 passport copy for my 2 settled worker
16)HMRC welcome letter (issued 2014)
17)Advertisements (Business card, Twitter, LinkedIn, website etc)

And No personal bank statements.

Finally I have received approval email (8/4/2020) for my ILR Set(o) 50k, thanks to Zimba & Marcnath for your help. Unlike the extension, it was quick.

Time line is as below

Initial Grant: Apr 2014
Extension Granted: Nov 2018 ( valid till Nov 2020, interview conducted)
ILR SET (O) submitted: 10/02/2020 (Self-employed)
Biometrics done (Sopra Steria Center, Croydon): 11/3/2020
Consideration email: Never

Below is my info that might be useful
Nature Business: IT
Work from Home (No office)

List of Documents:

0)SET (O) form
1) Two passports (main & dependant)
2) 2 Police registration
3) Cohabitation: EDF & THAMES WATER (both names are in the bills).a joint bank acc statements.
TV License, all for 1 year
4) Previous passports
5) Life in the Uk & degree certificates
