Tier 2 applying for ILR

Hi,
I have been on tier 2 visa for 4 and half years and currently planning to apply for ILR and I need your advice please!

Q 1 : My contract with first employer was for 2 years ending 30/6/17 so I found a new job with another employer who sponsored me and a new visa was issued on 17/5/17 but to start the new job on 2/8/17, so there was a period of unemployment from 1/7/17 to 1/8/17 would that affect my ILR ?

Q2: I will try to contact my previous employer regarding “absence letter” as I did not get one, do they need to mention all my fully paid Annual leaves even if I did not leave the UK ? Or only those related to a travel outside the UK ?

No

Hello everyone

I need your advice please,
I am filling SET O application tier 2 Five years route and on documents section while ticking boxes for documents required there is one for (Current BRP) then there is another box for (Evidence of Immigration Status) what evidence should I provide for the second one ?Is it the letter which shows Case ID that I was given with BRP ?

Some people have a visa vignette or other type of doc and not a brp.

Note that the checklist is generic.

English requirement for ILR

Hello
I am in the process of applying for ILR, SET O application (Tier 2- 5 years route)

I have done IELTS UKVI In 2015 at TR002 Centre which is still on the approved list of IELTS SELT Consortium and was used when I applied for my first Tier 2 visa,
Just to double check that I should be able to use same certificate to apply for ILR ?

Dear Members,

I need your advice please

I am a doctor and currently on Tier 2 visa and eligible to apply for ILR, my current contract is ending early August and very unlikely to be renewed as I finished training.

Giving the current situation with no priority services available this means my application for ILR may take few months and could be still in processing when current contract comes to an end in August, so I have two questions :

1-would that affect decision related to my ILR?

2-Can I work with another employer while waiting for ILR decision ?As I already have a Job offer from another employer

1. You need to be employed with your sponsor to qualify for ilr. You also need a letter from.rhem stating that you are required for the foreseeable future. So yes, no it working for your sponsor will affect your ilr.

2. No you cannot. You cannot workfor another employer if they sponsor you for tier 2 if you qualify (you cant have more than 6 years on tier 2 general) or if you already have ilr.

You can if you are working for the NHS. However, your ILR may not succeed.

Please can I have your advice,

My wife is on PBS dependent visa (Main applicant on Tier 2 visa applying for ILR-5 yrs route),

Her first entry clearance was on 14/9/2015
Her current visa expires on 16/8/20,

Can she apply for ILR on 16/8/20 ? Is that 28 days before 5th anniversary ?

Your advice is highly appreciated

So it would be Ok to apply on last day of her leave 16/8/20 (29 days before completing 5 years)- could this cause a refusal of her application ?or the casework can consider date of appointment for calculations ?

No.

Date of application is the date you submit and pay online. She needs to meet the requirements though when ho makes a decision

Please may I also check as I am applying for ILR and this could be using Standard service (giving no priority services are available) can she apply for PBS visa extension while I am waiting for ILR decision Then variate her application to SET O after 16/8/20 (While under section 3C ) ?

Hello Admin

I need your advice please
Tier 2 general 5 years route Applying for ILR SET O,

Is it mandatory to apply within the 28 days before 5th anniversary of entry to UK or would be ok to wait if current Visa is still valid ?
My first entry was on 17/6/15 but my current visa is valid until 16/8/20 so I am thinking to wait until early August in the hope that a priority service is open by then.

That'll be fine, you can apply anytime before your visa expires, as long as you completed your qualifying years.

Sorry so what Should someone do if he had to change his employer while waiting ILR decision ? Notify Home Office , withdraw application, Variate the application to to Tier 2 extension with the new employer ? Any idea please

You cannot apply for ilr based on 5 years tier 2 if you are no longer employed by your tier 2 sponsor. Ilr will be refused.

You cannot work for another employer while ilr is pending. You can only work for the employer you are currently sponsored by for a tier 2.
