Settlement Dependent (ILR) 5year route

Hope you all good
Please help me below.
My wife entered UK as my settlement dependent(5year route) in August 2015 and got renewal FLR(M) on March 2018 Visa valid until 24/10/2020.
1)
My Question: what is the latest date I can apply for her ILR is it 28 days before her visa expires (28 days before 24 October 2020 (from 27 September 2020?)
English language requirement: we used UK NARIC at the time of Visa extension FLR(M) March 2018 and did not take any English test. Will the UK Naric certificates be still valid now? Or do we need to apply again? please advise
2)
Our child was born in India and in Dec 2014. However, he first arrived in the UK December 2018 as my dependent. Can I apply for settlement at the same time with my wife in October 2020?

The EARLIEST she can apply is no sooner than within 28 days before the 5th anniversary of the date she entered the UK. The LATEST she can apply is the by the date her visa expires.

Should be fine.

your answer:
The EARLIEST she can apply is no sooner than within 28 days before the 5th anniversary of the date she entered the UK. The LATEST she can apply is the by the date her visa expires.


From the above I can understand :
She can apply for ILR on or after 27th July 2020 until/upto the the date of her visa expiry which is 24 October 2020 (she first arrived in the UK on 22 August 2015)

what is the latest date I can submit my application for ILR (FLR M) (Husband Settled in 2015 and got British later)

You can apply no sooner than within 28 days before reaching 5 years (60 months) residence and must apply no later than the date your current visa expires.
Date Visa (Vignette) issued: 22 July 2015
Date Entered Uk: 22 August 2015( as a dependant of settled person)

Your qualifying residence clock for ILR starts counting from the date you ENTERED the UK and not the date your visa issued date is.

No, there is an HO concession to apply WITHIN 28 days before reaching the 5 year mark.

You can apply WITHIN 28 days before 22nd August 2020.

Hi

Please can you clarify me below

How Financial requirement is calculated.
I am applying ilr for dependent and child under 5 year route (flr m) £22400 pa required.

As per employment letter annual gross income is £23860

if I check my yearly gross income as per pay slips it is coming up £22,200 per year after deducting pension every month.

does home office calculate gross income before deducting pension or after?

I am using NARIC certificate which was obtained during my extension in 2018 for graduation taught in english

I am confused

That question causes lots of confusion. I think it is trying to establish whether you previously applied for ILR (on or after 28th October 2013). Assuming you haven't, the answer will be "No".

Hi

I First entered the UK as partner of tier 1 general on January 2014.
Left UK on September 2014. due to pregnancy

Re entered as 'spouse of settled person' on 22 August 2015 - got visa renewal FLR(M) on March 2018 -Visa valid until 24/10/2020.

I am filling application for set M for settlement 5 year route, so I can submit any time from now until 24/10/2020.

Question : On 'Set M' application

previous address: when did you start living at this address: shall I mention August 2015 or need to give information from January 2014? I lived at same address from when I first came to the UK on January 2014 and after coming in August 2015 until April 2017

Related question: How long you have been living in the UK ? Shall I calculate from January 2014 or from August 2015? as I am only eligible to apply to 'settlement' only from 22 August 2015

Question: 'time spent out side the UK' . do I need to mention before entering as Spouse of settled person in August 2015 as well? I was away from the UK nearly 11 months + and switched my visa from Tier1 General Partner to Spouse of Settled Person in August 2015

I have now one more question on this: shall I calculate continuous residence from January 2014 and say 6 years 7 Months or take off the 11 months outside the UK during my maternity and enter 5 years 6 Months?
will it make any difference -please advise

Second one:
I did already mention time spent out side the UK before August 2015 for 11+ months
I Cant delete this now on the application

shall I leave it - will it make any confusion to my application

or would you suggest to fill new application as I have not submitted this one

No. Your ILR is based ONLY on the 5 years you have held the spouse settlement visa, i.e. from August 2015.
Second one:

Simply add a brief covering note with your supporting documents.

I answered for the question: How long have you lived in the UK? Answer: 4 years, 11 months
which is from August 2015 where I entered as spouse of settled person and did not include time from January 2014 where I was on Tier1 General Partner

is this correct?

The questions about how long you have lived in the UK and how long you have lived at an address are completely separate and independent of the qualifying period for ILR on SET(M).

You need to answer the questions truthfully, because UKVI will have your FULL history in front of them and know you have been in the UK before August 2015.

UKVI do actually know the rules and requirements you have to meet for ILR on Set(M) and what the relevant qualifying period is. This is nothing to do with the questions above in the form.

While uploading documents on UKVCAS - do I need to upload financial documents and accommodation documents on both applicants or if I upload on lead applicant is fine?
