Hey guys,
Just a small query. My wife is on tier 2 dependent visa expiring in June 2021 however she would become eligible for ilr in December 2021 which means that I need to apply her extension for 3 years.
I know that NHS surcharge is increasing from this October hence would like to apply for her extension now? Can I apply this early i.e. 9 months in advance?
My status being main applicant is ilr on tier 2 route.

As far as I’m aware, there are no grounds under the
immigration rules to refuse an early extension, when all requirements for an extension are met.
The applicable rules for a PBS dependant spouse is
319C.

Hi Hizzeon, can I know the outcome of your application please? I am in a similar position and would like to know what happened in your case? Did you apply 9 months in advance and your wife got the extension?

Hey,
I am still confused. I checked with couple of lawyers and all of them are confused. Apparently every lawyer says something different. 28 days, 3 months and anytime. I have looked into immigration rules and could not conclude that extension could be rejected due to early application.
Not sure what to do!

There is no restriction on applying early if you choose to. Many people do it for a number of reasons.

Thanks Hizzeon and Char, I think I am going to apply soon (within 3 months but >28 days) and take my chances. Worst thing is I will lose the fee..

Extensions are for 3 years from the date of approval!! It is NOT tagged onto the end date if last visa or from date if application!!
