chears, i got my stap 4EUFam yesterday after 5 months waiting.....but i was fingerprinted.......

While I do not condemn fingerprinting under all circumstances, fingerprinting family-members is IMHO unacceptable and PROBABLY illegal.

Please report this to the European Commission ( sg-plaintes@ec.europa.eu ) as well as Irish Solvit ( solvit@entemp.ie ), asking them if that's the way it's supposed to be... (Template giving some ideas >>here<<)

I think it's illegal, as directive 2004/38/EC sais the following about residence-cards, which clearly states what may be demanded (=and nothing more):
Article 10

Issue of residence cards

1. The right of residence of family members of a Union
citizen who are not nationals of a Member State shall be
evidenced by the issuing of a document called ‘Residence card
of a family member of a Union citizen’ no later than six
months from the date on which they submit the application. A
certificate of application for the residence card shall be issued
immediately.

2. For the residence card to be issued, Member States shall
require presentation of the following documents:
(a) a valid passport;
(b) a document attesting to the existence of a family relationship
or of a registered partnership;
(c) the registration certificate or, in the absence of a registration
system, any other proof of residence in the host
Member State of the Union citizen whom they are accompanying
or joining;
(d) in cases falling under points (c) and (d) of Article 2(2),
documentary evidence that the conditions laid down
therein are met;
(e) in cases falling under Article 3(2)(a), a document issued by
the relevant authority in the country of origin or country
from which they are arriving certifying that they are dependants
or members of the household of the Union citizen, or
proof of the existence of serious health grounds which
strictly require the personal care of the family member by
the Union citizen;
(f) in cases falling under Article 3(2)(b), proof of the existence
of a durable relationship with the Union citizen.

NEW CARDS

Hi, do you know anybody about the new cards with fingerprints?
I read everybody is getting new version now. Do I need to exchange my older one?

You'll get one of the 'new' ones when you go into renew.
Anyone know why we are being fingerprinted anyway?
This is a question that I intend on asking when I go into renew.

very difficult to explain, i got a letter exactly 5months and i went to GNIB d same day but i was fingerprinted.

i had two residents permit in 2 EU STATE before coming to ireland MAYBE also its helped.

will you complain about having been fingerprinted with the Commission/Solvit?

I already lodged a complaint with the Commission, but as we are not affected ourselves I cannot ask Solvit to intervene. (I merely CC'd them on my complaint, so they are aware that there is a new issue.)

Should you decide to do so, please let us know how it goes :)

About the fingerprints, are they taking from every one or those who had thier another country residence permit

Hi Folks,

We've just got letter from DOJ and have been approved 5-year residence card after 4 months (we applied in May/2008)

We'd like to thank you guys for yours priceless information that guided us through this process, it wouldn't have been possible without it!! Also thanks for Ca.funke who has been working hard in this forum, well done buddy!!

sorry for being later to answer your question No exception all non-eu should fingerprinted, even i made a serious argument with them but d lady said d directive came from above that all non-eu should be fingerprinted including eu-spouse
