Can a work permit holder's dependent switch to Tier 1? Help!

Can a work permit holder's dependent switch to Tier 1? Help!

I moved to UK initially in Jan 2003 as a student. Got work permit in June 2007. I am a work permit holder in UK since June 2007 and it is valid until june 2012.

My wife initially came to UK in Sep 2002 as a student, she did PG diploma in computing from Liverpool University and is dependent on my visa since june 2007.

We want to get her visa changed to Tier 1 (HSMP) and I want to be a dependent on her. The questions I have are:

1) Can she apply for tier 1 from UK itself without going back to home country? She qualifies with 80 points.

2) Will I need to go back to our home country to apply as a dependent?

3) We are planning to apply for her tier 1 visa and once it is approved only then I will apply to be her dependent. This is to ensure that atleast my work permit is there and we can use my wok permit as a safety net even if tier 1 is not granted to her.

Please advice and if you want more information. Please ask!

No, She has to go back to her home country to get her Visa. Its clearly given in Home Office website about various categories that can switch in-country. Take a look!!
