Tier 2 General Change of Employer

Post by ankitperiwal » Fri Oct 16, 2020 12:56 am

Hello Experts,

I'm currently on Tier 2 General and going for a job change. My visa application is successfully processed and I'm waiting for the new BRP.

My queries are:

1. I am planning to take a break for a month between the job switch and travel out of UK, would that be an issue?

2. After I get my BRP, in case I don't want to switch, would that cause any issue? I know I will not get any refund on the application fees, is there anything else apart from this? Does receiving the new BRP make my current BRP invalid?

Please help me answer the queries.

Thanks in advance! :)

1. Should be fine, however take note of changing lockdown restrictions. Important to remember you are sponsored to work in the UK and absence limits apply to you.

2. Your previous tier becomes void once a new tier 2 change of employment is approved and your previous brp is cancelled. If you choose not to change jobs/employer and remain with your previous sponsor, you have to apply for a tier 2 visa again, meeting all the requirements.

Thank you for your response @CR001
On the 2nd point, I have one other question: I have not handed in my resignation with the current employer but was planning to do so once I receive the new BRP which means during the notice period,
I will be working with my current employer while holding the new BRP. Is that ok to do so considering my old BRP will be cancelled?

Thanks!
