SET(O) required documents

Post by Superoverflow » Sun Nov 01, 2020 11:50 am

Hi All

I am checking the documents required for SET(O)
There are two documents I am not quite sure but I wasn’t able to find clarification from gov websites.

Does anyone have experience/knowledge what they are:

1) Evidence of _____’s immigration status in the UK
- I suppose this is BRP. But there is already a separate line item for that tho :?

2) Declaration signed by ______ to confirm consent for the Home Office to request verification checks
- In the application form, there is a page “Declaration”. i just put “I am the applicant”. Is this the declaration or there is a separate form :? I am already at the payment page but I still don’t see any form like that

Many thanks and good luck everyone!

How is the start date count for the ILR 5 year qualifying period

Post by Superoverflow » Wed Nov 04, 2020 10:59 am

Hi

May I get some advices regarding the start date of the ILR 5 Year Qualifying Period.

So my timeline is below:

1) The "Date of Issue" for my BRP is "24/11/2015"
2) The "Valid From" date on my passport Tier 2 Visa Vinaigrette is "30/11/2015"
3) The date I arrive UK with my Tier 2 Visa is "06/12/2015"
4) The "Work start date" on my Certificate of Sponsorship(CoS) is "07/12/2015"

I was looking at the Tier 2 Settlement guideline:
https://assets.publishing.service.gov.u ... 0_v1.1.pdf

Code: Select all

264. You can include the time between your entry clearance being granted and you entering the
United Kingdom as part of your continuous period. Absences between the date entry
clearance is granted and the date you enter the United Kingdom are treated as an absence
from the United Kingdom and will form part of the 180 days allowed within a continuous 12-
month period.
It seems to suggest that I can use 2) as that is thhe "entry clearance being granted" date as my 5 year period start date, and I will need to take that 6 days between 2) to 3) the date I enter UK as part of the 180 days allowable leave period.

Is my understanding right? If so, should I also list this 6 days in my immigration absence history?

Many thanks for the advise

24/11/2020 (initial visa issue date) minus 28 days. You are already eligible.

Hi Superflow
I have similar issue. Did you submit application based on eligiblity from brp issue date? Have you gotten ILR approved?
I will appreciate your response. Thanks
