Could she be "removed" from the UK

Post by quixote1 » Mon Sep 15, 2008 1:48 pm

Hello,

Please could someone shed light on what would happen to my Brazilian wife if we didn't renew her FLR (the application is in the post so the question is academic, but we discussed this around the dinner table yesterday without resolution). I'm British and we have a British born daughter of 18 months (she has a British passport).

If my wife didn't have FLR or ILR would she really be liable to be "removed from the UK" or in practice would having a British baby daughter / full grown British husband mean that various appeals would more than likely prevent her removal ?

Thanks ... Matthew

She would be treated as an overstayer. British husband (full-grown or half-grown) and child regardless.
