Post by NutanRaj » Wed Sep 17, 2008 9:51 am

Hi Guys
This thread for the people whose HMSP Extension was rejected under old rules even after JR....

Recently one my friend Brother case was rejected as stating 'He was not economically active'

He came to UK in August 06 and send for Extension in July08.
He was a Botony lecturer in India but did not get opportunities in UK teaching field...He did not show much interest in doing hard jobs ...He uses to do hard job only for his survival...he was keep on trying for Botony jobs and applied for many jobs and attened the interviews....

He send all the letters, email conversations and consultents reply for his extension....but they rejected stating 'ECONOMICALLY NOT ACTIVE'

Last point: he got a job in Botony as permanenet teacher in a school just 2 days before of his rejection letter...

He received the letter on Sept 10th and they have given 28 days to leave the country..Now what to do ...

Any idea..?

Hi NutanRaj,

Please, advise your friend to look through the BIA website and see the requirements for extension. He only needs to show that he his 'economically active' by showing proves that he has been working in the last 12 months using his Bank Statement and payslips and all other required documents. It doesnt matter what kind of job he does.
But if not economically, he has to show evidence that he has made every efforts to find a job but couldnt in his field - which are corresondences from agencies/employers with him.

But its very tough if you claim that you are not economically active in the UK,it means you are not contributing or adding any value to the UK and HO will wonder how you have survived through these periods of time without been gainfully employed or started your self employed business. Is anyone (family, friends etc) responsible for your friends upkeep in the UK? If so, let him declared this on the form as there is a space for him to declare this.

He has to be proactive on this.He should write a clear and simple cover letter explaining hos circumstances in the UK and that he has found a job now.He should be very polite in his letter. I think he should go for an appeal before the 28 days.

I wish him well

Cheers.
