Extension or ILR

Post by Marclck » Tue Dec 29, 2020 1:28 pm

Hi all - greetings

I currently hold a 5 year tier 2 general expiring 30 sep 2021.
Upon expiry I’ll be eligible for ILR (5 years).
My wife who is my dependent (dependent visa) expiring the same.
We are buying our new home where the lender requests at least 2.5 years on visa.

I am debating myself what to do next and hoping that I can get some advice here from whom had similar experience.

I think the options I have are the following:
1. Applying for ILR in Sep 2021
Pro: simple, save money
Con: risky, if rejected we will have to leave UK; no mortgage available until ILR granted.

2. Applying for a tier 2 extension now and apply for ILR when ready
Pro: less risky, will allow more time to ensure ILR qualification and application preparation; will get a mortgage deal.
Con: more expensive, more complex

My question is: would I be allowed to extend my tier 2 for another 3 years (more than 6 years in total)? I heard the 6 years limit has been lifted but I cannot find it in guidance. Please could you advise?

Thanks with regards
Kai

Hi moderator

Thank you for your reply.
Does this mean this article is misleading?
The article mentioned that from January the 6 year limit is abolished.

Actually I found this:
https://assets.publishing.service.gov.u ... ssible.pdf

Page 24 - 6 years of maximum stay has been removed under Tier 2 skilled worker scheme.

Could you help clarify please? Does this apply to new entry only and not for extension?
