Tier 2 ict primary to PBS skilled worker visa dependent conversion

Hi ,

This I am posting on behalf of my friend.

He is on tier 2 ict primary visa holder and recently his wife got a PBS sponsorship so now he wants to see what is the possibility he can move his visa category as her dependent.

Does he needs to inform his employer about the visa conversion or once he converted he thinking about to resign so he wants to know what are the complications and what is the better way he can proceed.

He needs to inform his employer once his dependent visa is granted to prove his right to work.

Makes no difference when he resigns.

Thanks for the reply the situation is that his employer will not allow to work as dependent visa so what you are saying once his has been granted the visa he can inform employer for change of visa?

My husband also in same situation. As per his organization policy, he cannot work with PBS dependant Visa. He's planning to get PBS dependant visa before he put down his paper with his current organization. But my query is as soon as he submitted his application for dependent visa, will the organization get notified? In such case will they take any legal action since its against organization policy?

1. You should post in your own topic instead of tagging onto other members topics.

2. No, the employer is NOT notified when someone submits another visa category application. The organisations policies is irrelevant to the immigration rules.

1. Whether the employer will be notified by home office after the visa of my husband changes from ICT to Dependent since the ICT visa is tagged to the employer?
2. What will happen if he failed to inform the employer even after the visa change until the ICT period ends?

1. No. It is the visa holders responsibility to inform their employer of their change in visa status and provide evidence (BRP) card.

2. He must inform his employer. It is not a "choice". He must provide evidence of his right to work in the UK. If his visa has changed, the ICT employer has to update their records and the SMS.
