Hiya Folks,

I just cant believe the changes to the WHV and the inability to switch to the HSMP, unless my occupation is on the shortage list (which it isn't)!!!

Anyways - I submitted my HSMP application at the end of Jan. The application was dated 20 Jan, and couriered to the HSMP people on 21 Jan, but the payment was only taken from my account on 9 Feb.

I believe that if my application was received by the HSMP people before 8 Feb, then my HSMP application could be successful as it would be assessed on the "old rules".

Can anyone shed any light on when they reckon my application would be assessed...either pre 8 Feb or after?

These changes just seem so harsh - I am a business professional working in a specialised area of banking and involved in high profile work, but since I'm not an actuary I cant' switch - how ridiculous.

Any advice

Oh yeah also, does anyone have the contact details for the HSMP people...they dont seem to be contactible through the numbers detailed on the homeoffice website?

Richsam,

As far as I understood, the changes to WHV regs state that you cannot change status to Work Permit whilst on WHV unless on the shortage list. You may still switch to HSMP.

Actually, reading the paragraph again..

' may now only switch into employment in the following categories: Innovators, Highly Skilled Migrant Programme or Work Permit employment, if the occupation is on the list of designated shortage occupations maintained by Work Permits (UK).'

This could be interpreted as you have, or as I have!!!!

Can anyone clarify?

i dont think the rules apply to you at all, cause you already had you WHV prior to feb 8, its those who are getting the WHV who will be subject to change

My apologies for misleading you there, it seems the new rules do affect those already holding WHV, well the one about switching to WP, unless of course the WP application was recieved before Feb 8, which in your accuse you can argue it was. i am sure (hope) they will excercise some leniency on the matter, otherwise you will have to return to your home country for EC


The amendment in relation to switching will become effective for all in-country further leave to remain applications which have been submitted on or after 08 February, regardless of when the working holidaymaker obtained entry clearance.

As a transitional arrangement, all work permit applications submitted prior to the 08 February for which a subsequent FLR(IED) application has yet to be made, or decided, will still be considered under the pre 08 February Immigration Rules.

This also means that any working holidaymaker for whom a work permit application is received on or after 08 February will now only be allowed to switch into work permit employment if they have been in the UK for at least 12 months, as a working holidaymaker, and the vacancy is one listed on the work permit shortage occupation list.

well you guys wont believe this...but it seems that i have received my hsmp visa. a friend of mine received the letter on my behalf (as i am busy moving house), notifying me of the result.

i only submitted the application at the end of january!!!

anyways, my following question is: now i have to apply with the flr(ied) form to vary my current leave status. since i am only applying for this after 8 feb, do you guys think that this will be successful?

is it just a formality as my hsmp visa has been granted?

I think since you submitted your HSMP application prior to Feb 8 you should be okay. Congratulations on your successful application for HSMP, I think it is now expected that most of the December and January applications have been processed
