Domestic Violence. Please guide me how strong is my case

Post by Minazee » Sun Mar 07, 2021 9:22 pm

I came to UK last year. I was pregnant. Soon after I cane my husband started hitting me. It never left any mark or anything. I never told anyone. There was alot of mental, emotional abuse going on as well. My inlaws were pretty abusive too especially regarding my child and making me neglect him.

I told my midwife and womens aid. They involved children social services which told me I need to move out or they will have to assess my inlaws and husband and might put child protection plan in place. I being already scared of my inlaws and husband chose to move out to a refuge. I have a baby and expecting another one soon.

Now the refuge applied for my ddv and I got it within a week. They are now gonna apply for ilr. I want to know how strong is my case. I only have these evidences:
  • My midwife report
Social services report(they have been assessing my husband as well)
I emailed domestic abuse agencies, womens aid and flows. I have their reports
    Marac report
    Refuge where I am staying
Bank statements since he used to take money off me.
I was called to my GP to move me to refuge and police escorted us to remove us safely. So I am not sure if they would give their reports. Since I didnt call the police. Social services did and they arranged the meeting at gp. I didnt go to gp for any injuries.
I have a recording in which my husband claims to have hit me and he's abusive in that recording, taking my phone away, treating me like a child etc.
Do I have enough evidence to make my case strong. I dont want to go on parental visa since I am 8 months pregnant atm and have a little boy, it will be hard to survive.
Thanks in advance

This is highly unlikely to be accepted. It could be anyone on the recording.

Sorry to hear that you have been in such a difficult situation.

As far as I am aware of, your chance to get DV ILR is quite good. The home office makes decision based on the balance of probabilities. It means you do not necessarily need to prove all their abusive behaviour within the police report. You have been in touch with child care, the MARAC report is an strong evidence. Your solicitor can apply for legal aid and get a non-molestation order against your husband which is again another good evidence. I believe even without the non-mol order, your chance of getting ILR is high. Hope this could help you.
