ILR - time away from UK - covid19

Post by AjPS » Sun May 16, 2021 10:01 am

Hi,
I am a UK ILR holder since Jan 2019. Due to us all working remotely and the covid19 pandemic, I flew back to India to stay with my old parents, in Nov. 2020.
Now, with India on the travel red list and being worried about my parents being alone, I have chosen to continue staying at home in India and working remotely for the past 7 months.

I believe my ILR remains valid provided I return to UK within a 2 year absence. And I plan to return hopefully in 2-3 months. Just want to confirm this won't cause Visa and reentry issues? Pls advise.

Thanks.

P.S. not sure how this will affect my plan to in future apply for naturalisation/ UK passport? If I need to show total absence from UK for 5 years to be under 450 days and am away a year due to covid19, I guess I can only apply for UK passport after another 4 years of ILR then?

Less than 24 months should not be a problem. Also, you cannot directly apply for a British passport, you must apply to become a citizen first which has specific absence requirements. So far there are no concessions for the Nationality applications

I have since been away from UK and working remotely. Have left my rented flat too to save on rent. Hope that doesn't affect my existing ILR as am still employed in UK and aim to return once India goes off the covid19 red list and rent a new flat in the same town. My UK belongings are stored at a british friend's place

Thanks, so I was right to avoid wasting money on uk rent whilst working remotely from India.
Eager to return once India is off the red list and get a new place to rent and live in UK

Your personal decisions (renting, working, etc) are not relevant to your ILR status. ILR status is lost only under specific circumstances

Thanks Zimba, am now planning to return next week but have a new flat I am renting with same landlord. Should I update UKVI online records somehow with new address, in case am asked to write my UK address on arrival?? thanks.

P.S. my 1-day home quarantine will be in a different building though (also owned by same landlord) so which address should I use in any covid/visa forms? my original address that matches my UK BRP, or my new one or the 1-day quarantine one?

1. It is not necessary to post the same question multiple times when you have asked it in this existing topic already.

2. There is NO requirement to update UKVI of addresses once you hold ILR.

3. Simply complete the form with the information required if necessary.

Thanks CR001, ok but which address to use in passenger locator form?

new one (new tenancy starts next week)?
or Old one matching BRP (my UK rental address until Nov2020, I flew home in June2020)?
or temporary quarantine one (where I will stay for 10days to isolate)??
