Domestic violence

Post by Gul khan » Thu Jul 01, 2021 8:06 pm

I arrived in the UK three months ago.am victim of domestic violence from wife and mother in law. They mentally tortured me a lot.
They kicked me out of the house. Social organization provide me accommodation.I am taking depression pills from the doctor.
I also informed the police. But there is no evidence of mental torture and domestic abuse, so the police took no action.
I've got a DVD concession for three months.
I have applied for funds.
Let me know plz how my case will be strong for ilr

So, you came here just three months ago and your marriage has already failed, but you don't want to go home? I'm not sure you have a case to remain in the UK, just because you married a person you did not get to know beforehand, means the HO may well see your marriage as a sham with not even any evidence that you were domestically abused, could well take the view that you used her to get here.

You are very unlikely to be granted ILR as you have been here for only a few months.
All evidence submitted must be considered and a conclusion drawn as to whether
there is sufficient evidence to demonstrate that, on the balance of probabilities, the
breakdown of the relationship was as a result of domestic violence. Factors to be
taken into account when assessing the evidence include:

• timing of the application
• length of relationship before the application is made:
o the fact that the relationship broke down due to domestic violence during the
very early stages of the probationary period, may not be an adverse factor in
reaching a decision to grant indefinite leave to remain (ILR) but in the
context of the immigration history as a whole may give rise to suspicion

• previous immigration history, particularly where there is evidence that the
applicant has made a number of attempts to secure leave in the UK on different
grounds

• length of time since the alleged incident and reasons given for any delay in
submitting an application

The fact the couple are still living at the same address when the application is made
may not necessarily be taken as an indicator the relationship has not broken down,
as this could be due to a number of reasons.
