ILR Set O - 28 days rule, visa issuance or date of entry??

Hi,

I am planning to apply ILR in December. I am presently on Tier-2 general Visa.
Can someone pl. answer following questions.

1. My entry clearance has Valid from date as 30th-Dec-2016. Shall I calculate 28 days based on this date or date on my BRP or date of entry into UK (3rd-Jan-2017) or date on COS employment start date (1st-Jan-2017) ?

2. I changed my visa from Tier-2 ICT dependent to Tier-2 General in Dec-2016. Subsequently, my wife (She was on Tier-2 ICT) and children visa was changed to Tier-2 dependents (based on my tier-2 general visa). Their BRP has date of issue as 17-Jan-2017 and valid until 14-Jan-2022. When can they apply for ILR.

3. Is it possible that I apply ILR first and then apply for dependents later (After couple of weeks when they become eligible.)

Do not tag your questions onto other ILR topics.

1. Your qualifying time start from the initial visa issue date.

2. No sooner than within 28 days before their initial Tier 2 dependent visa were granted, ie 17th Jan 2022 minus 28 days.

3. Yes. However, you can all apply together in towards the end of December if you choose to, which means only one form has to be completed for all of you.

Could I please ask you what you mean by "The initial visa"? Are you referring to the "Entry Clearance" visa which is glued to the passport and which has one month of validity from the date of issuance? Or are you referring to the letter of acceptance received with which the passport is sent to get the "Entry Clearance" visa?

Thank you very much for quick and precise reply. I have one more question regarding English language requirement.

1. I got "Qualification Level Statement" and "English Language Statement" from UKNARIC in year 2016, when I got my Tier 2 GENERAL Visa. Will that be valid for ILR application.

2. Similarly, I got "Qualification Level Statement" and "English Language Statement" from UKNARIC for my wife in year 2017 but my wife's certificate shows "Department of education" on top right corner of certificate instead "Home Office" (as shown on my certificate). Is it valid for English requirement.

Having used successfully before If assessed as being at required level for ILR I.e. B1 then it's reusable. Note that I don't know what the level statements looks like and you have not stated what level.

Hi,

1. I am came to UK on Tier -2 General in 2016. I recently got my ILR. My dependents came in Jan-2017 on tier-2 dependent visa. For dependent's ILR, shall I use Set (O) or Set (M). I have settled status but dependents are still on Tier-2 General dependent visa valid till Jan-22.

2. My daughter is 16 years old and as per ILR documentation, a letter is required from school or NHS or any utility bill to validate her current address. Can anyone pl. share wording or template of letter needed.

That will be from 2nd December, for peace of mind can submit 3rd. Based on above info with relevance being to visa issued date

There is a question "Have you previously lived in a country outside the UK including your country of birth?" in Set (O).

- Shall I add any information of visitor visa also. e.g. I visited France for 5 days?
- Also, Do I need to add previous UK visits (on business visa) also? (e.g. I visited UK in 2003, 2008 and 2010 on business visa).

No. It clearly asks "lived" and not visit.

I have recently submitted set (o) for ILR. I have an appointment on 13th Dec. I was reviewing my application.
In the consent section, it asks.

Does the account with the bank or utility company for which you have supplied information and
supporting documentation relate to another person who is to provide you financial support?


My wife contributes for house mortgage and utility bills. Should this option be mentioned yes or no. I have mentioned Yes. If it should be No, how can I change it now?

I have query regarding English requirements for my wife. We evaluated our degree certificates from UK NARIC to satisfy English requirements. The English requirements certificates I got from UK NARIC are different for me and my wife. Pl. see the attached images. I have used my certificate during Tier 2 General application, so it is fine. Is my wife's evaluation certificate will be fine with Home office. I have highlighted differences in attached images.

Observation is that both were not evaluated in the same year and the format could have changed in-between. Point to note is the level at which both were evaluates which is above the required level B1.

I had a look on ECCTIC (UK NARIC) web site and found there are different kind of certificates issued for different purposes. For my wife I opted for "Job Purpose" rather than "Visa and Nationality Purpose". I also found following statement for "Job Purpose certificate" on ECCTIS website

This service is for you if you need to evidence the level of your overseas qualification for employment, study, professional registration or another reason.

If you need to evidence the level of your degree and your English language proficiency for the UK Home Office, you may need to use the specialist Home Office-focused services, the Visas and Nationality services.

Do you think still I can use this certificate

My wife is going for English language test tomorrow. I saw on Trinity college website that provisional result will be provided next day and certificate will come in 7 days. Can provisional result be used for for ILR Set(O) application or I will have to wait for final certificate.

For the application, the UER is required, if the provisional result has the number fine otherwise you may have to hold on till certificate is received.

I got my ILR BRP (today ) and now I am filing ILR for my dependents (Wife and 2 kids). There is section on
Set (O) for dependents with heading "The person you are joining or accompanying".
Question 1: My details will go here right?
Question 2: It asks for BRP number. Which BRP number will go here ILR or My old tier 2 General?
Question 3: Then it asks "Which visa is Mr NAME applying for or been granted". There is no option to
select ILR here. I assume Tier 2 (General) will be selected here, even I have ILR now. Is it correct?
