Does my partner meet the 5 year requirement for ILR?

Post by GTguy » Wed Dec 01, 2021 8:09 pm

I will qualify for an ILR this March 21 under the Tier 1 Global Talent visa route.

Can my wife, who is currently on my dependant visa, meet the eligibility criteria to be included in the same ILR application as me?

She has 2 years on a tier 2 visa and 3 years on dependent visa. Can she combine these years on different visas to meet the 5 year requirement for the ILR or does she need a total of 5 years on a dependent visa? Thanks!

Did she hold her own employer sponsor Tier 2 visa, ie not a tier 2 dependent visa?

If yes, then she CANNOT combine Tier 2 time with PBS Dependent time to make up 5 years for ILR.

She needs 5 years as PBS Dependent before she can apply for ILR.

You were advised of this in early November.
