Applying for US Citizen Husband while we both live in Pakistan

Post by Alicenemo » Wed Nov 10, 2021 11:40 pm

Hi, I'm looking for some guidance about visa application for husband (US) to move to the UK. Currently we both live in the US, I'm on a visit visa. We'll both be going to Pakistan for a few months until his UK Spouse visa comes through. My questions are the following:

1. Are there any specific documents I will need other than the already mentioned ones on the gov.uk website if i live outside the UK while applying for my husband?

2. I came across a few posts that mention proof of address in the UK or some kind of living arrangement. However, since I am not in the UK I do not have a living arrangement, will I need to be in the UK before I apply or are there exceptions to when both parties are out of the country?

Any tips, guidance from you all would be much appreciated.

Thank you!

I would also like to ask if it would be better to apply from the US rather than Pakistan considering currently most applications are delayed from Pakistan?

Spouse Visa for husband

Post by Alicenemo » Thu Nov 18, 2021 12:13 am

Hi everyone!

I feel like I'll get my answers on this post. Please let me know if I'm not allowed to post different questions here I'll remove this post.

My husband is am American citizen and he's going to apply for his UK spouse visa from Los Angeles. We have all the documents in place but there's some confusion about his passport being submitted.

I'll elaborate, I'm on a visit visa in the US currently, my visa runs out on the 15th of December 2021. So I need to leave before then. Me and my husband decided to apply for his UK spouse visa here in the US and go to Pakistan together wait for the visa to come through and then fly to the UK from there after a few months (90 working days?).

We had heard from a lawyer that when filing the application there is this option to keep your passport with you until a decision is made, and that you are asked to submit your passport once they've made a decision and will need your passport to stamp on it (rejection/approval). However, now that we're looking to file the application this week we are entirely unable to get any definite answers if such an options exists to begin with. There seems to be no information about this on the VFS website or the ASC website nor the UK.Gov website. I called the embassy helpline and they told me they can't say and I'll need to ask the local visa office. But there's no contact information for the local visa office that process your passport for the application.

I would appreciate any tips, guidance, advise from you all that could put us in the right direction.

Thank you for reading my post.

I think you are complicating matter. Just apply for Pakistan and wait for the application to arrive from there.

If you intend to apply from the US and you opt for keep my passport option, you will need to send your passport back to them once the visa has been granted as it is likely your vignette will be sent to Pakistan where you are currently visiting.

Hi, thank you for replying to my post!

Applying from Pakistan is definitely our last resort, as we've been seeing massive delays in spouse applications applied from Pakistan here on this forum. Some of the lawyers we consulted suggested that applying from the US might get us a verdict within 12 weeks. My husband already has a really good job offer in the UK given that he joins by February 2022, so we're kind of stuck between a rock and a hard place :/

However, I do appreciate your reply. Look forward to more guidance/suggestions from you all. Thank you!

Wife currently not living in the UK

Post by Alicenemo » Wed Dec 22, 2021 6:41 am

Hello everyone, I am applying for my British Visa (spouse) application from Pakistan. I am a US Citizen (wife is British) but due to conflicting travel plans I was unable to apply for my visa from the US, hence now I am applying from Pakistan. I have three questions:

1. Is my application process going to be any different in Pakistan due to my US passport?
2. Would it be more favorable/faster if I applied with a Pakistani passport from Pakistan?
3. My wife is currently staying in Pakistan with me, hence she has no accommodation document in the UK, however, she has years of history of paying rent in the UK up until June of this year. Can she show proof of previous accommodation or do we have to arrange a stay with a family for the purpose of this application?

Any advice/tips would be much appreciated.
Kind regards,
Sam.

1.No
2. It won't make any difference to be honest because even if you apply with a US passport, your application can also take long to be decided.
3. You definitely need an adequate accommodation available to both you maybe you can use her parents accommodation for this purpose.
