Tier 2 dependents on ILR 'lapsed' due to naturalisation

Post by aadubaal » Wed Jan 05, 2022 6:01 am

I had ILR, and had two dependents on it. I recently got naturalised. The dependents' visa (based on the ILR) is valid till 2024. The ILR has, of course, now lapsed, and sent back to the authorities.

Will they need to get a fresh dependent visa before 2024, because the ILR on which their visa was based no longer exists? Or can they convert to a British citizen's dependent visa after their existing visa expires in 2024?

It is unclear from your post what the situation is.

If they have a tier 2 dependent visa visa or ILR, it doesn't just "lapse" because you become British.

What visa or immigration status do the dependents currently hold exactly?

Apologies if I have ended up confusing you.

Their BRP says 'Leave to enter' and 'Work permitted'. Their visa was a dependent visa (assumedly Tier 2) on the main visa that was my ILR.

Does this answer your question?

They simply extend their PBS dependent visas if necessary and apply for ilr on form SET O when they meet the requirements.

You becoming British is irrelevant to this.
