indefinite leave to remain after student visa??

Post by ultramariner » Mon Nov 10, 2008 1:02 pm

If I had a continuous student visa for 4 + years, is it right that I can apply for indefinite leave to remain?

Yes, but after 10 years.

Five years is for WP/HSMP folks. And Ancestry I think.

But I believe that the HO intend to abolish ILR for Students if the new
regulations contained in the Path to Citizenship green paper is passed through Parliament for introduction in 2009.

Yeah a lot can change in the next 5/10 years.

My theory is the 10 year any legal stay and the 14 year criminal stay will go pretty soon.

In the case of the latter, not before time.

My vote would be for no ten year stay for adult students deliberately taking pointless course after pointless course just to rack up the 10 years. I mean, who needs a 30 yo ACCA, MCSE, CNNA, OCP, who's never had a proper job...

OR you may be lucky if government decide to apply new rules to only new commers and not on those already in the country (Many news papers reported this on 20th Feb 2008)
Austrilia is the best example I think. When they increased the time to obtain the passport (If I am right from 3 to 5 years) they applied rules on only new commers.
