I'd like to ask some information regarding the following case.
A friend of mine stayed in London for several years.
He came at first on a 6 months visitor's visa and got married before his visa expired.
After his marriage the Home Office switched his visa into a spouse visa.
He has never applied for ILR in UK as a consequence of the fact that his wife took hold of his passport since day one and never allowed him to follow the procedure to settle his position in UK. After 4 years of marriage she kicked him out of the house and kept all his belongings and documents with her. Despite he tried very hard to get his documents back she always showed resistance. He also sent the police but without obtaining any result.
He kept living in London for a while without settling his position. When he decided to get back to his own country he had to apply for a travel document and the Consular Division High Commission issued a single journey emergency passport. In the airport, before boarding they took his fingerprints, questioned him about his past life in London, issued a form and put a stamp and definitely put his details on record. He also heard about the possibility of being detained under the asylum and immigration act.
Now it happens that his parents (American citizen) who live in USA applied long ago for immigration visa to call him to stay with them. At the present his immigration case is on the final stage and he has to submit a police certificate from the ACPO which will provide the results of a criminal record check.
Because of the unfortunate circumstances he overstayed in the UK.
My questions are:
1) Will his overstay period be shown in the ACPO police certificate?
2) Will this compromise his USA immigration visa case?
