Applying for Tier 2 skilled worker while having an asylum case open

Hi,

I applied for asylum before expiration of my Tier 4 Doctoral extension Scheme visa.

I was wondering if someone can advise whether it's possible to apply for a Tier 2 skilled worker visa while having an asylum case open.

The substantive interview has not been arranged yet after 10 months of initial interview and now the employer offers to sponsor Tier 2 skilled worker. The Tier 2 application is ready to be submitted, however my passport is with HO as part of the asylum application.

I'm not sure how i can retrieve my passport back and apply for my tier 2 visa? Do I need to leave the UK If I was to withdraw my asylum case.

If anyone has any advise I'd highly appreciate it!
