Apply Asylum or later uk spouse visao

Can a person in uk apply for asylum / asking for someone on spouse visa , going back to home country is not an option so if spouse visa does not continue can the applicant apply asaylum

What leave does the person have to be in the UK currently spouse you say? Is the marriage strained? BC child or children?
